NIGHTOWL STATE OF ORIGIN JERSEY PROMOTION (“PROMOTION”)
Special Terms and Conditions
GENERAL ENTRY CONDITIONS
1. Information on how to enter this Promotion and collection of any prize form part of
these Special Terms and Conditions (Entry Conditions).
2. Entry into this Promotion is deemed to be acceptance of these Entry Conditions.
3. The Promotion is open to:
(a) All residents of Australia; and
(b) If under 18 years of age, have obtained permission from their parent or guardian
to enter into this Promotions on these Entry Condition and whose parent or
guardian has read and agreed to these Entry Conditions; and
(c) Are not employees (or immediate family of such employees) of the Promoter or
SCHWEPPES or SMITH’S, or any of its associates, related entities, affiliates,
officers and employees or any of the agencies associated with the Promotion
(including providers of the prize(s); and
(d) Entrants who have not been banned from entering into competitions with the
Promoter for a breach of previous promotions or competitions.
(Entrants)
Immediate family members of an employee includes: mother, father, step-parent,
grandparents, step-grandparents, brother, sister, spouse, ex-spouse, de-facto partner,
child, step-child, uncle, aunt, niece or nephew.
4. By entering into this promotion, the Entrants (who must be eligible to enter) agreed to
be bound by the Entry Conditions. The Promoter reserves the right to amend or vary
these Entry Conditions from time to time and to disqualify any Entrant due to any
tampering of the entry process or any Entrant who does not submit an entry in
accordance with the Entry Conditions.
5. It is an Entry Condition that each winning Entrant accepts its prize as stated. If a
winning Entrant is unable to accept its prize as stated, on the dates required, then it
will be deemed that that Entrant is an ineligible Entrant and any prize won by that
Entrant will be forfeited.
6. The Promoter reserves the right to redraw any unclaimed prize from a participating
NightOwl Convenience Store or NightOwl Super Store in the event of an Entrant failing
to comply with these Entry Conditions or forfeiting or not claiming its prize within 7
days after notification of the winning Entrants (Unclaimed Date). If any prize remains
unclaimed by the Unclaimed Date, then a second draw will be held at 12.00pm AEST
the day after the Unclaimed Date, which can be held at each location where the
unclaimed prize may be situated or at NightOwl Franchise Support Office. Disposal of
any unclaimed prizes may be made subject to any written directions given by the
government authority and pursuant to any relevant legislation. Each unclaimed prize
draw winner will be contacted by telephone or email immediately following the second
draws (if any).
7. It is a condition of this competition that the winner of each prize must consent to the
use of their image for promotional purposes associated with the promotion, without
reward. The Promoter reserves the right to refuse to allow any winner to take part in
any or all aspects of a prize if the Promoter determines, in its absolute discretion that a
winner is not of a mental and/or physical state to be able to safely participate (or
continue to participate) in the prize.
8. All prices stated are in Australia dollars, represent the recommended retail price
(“RRP”) and include GST. All references to times and dates are dates in Brisbane,
which are Australian Eastern Standard Times.
9. Any change in the value of each prize between the competition commencement date
and the date the prizes are claimed is not the responsibility of the Promoter.
10. Neither the Promoter, the company providing the prizes or associated bodies will be
liable for any loss or damage or personal injury suffered or sustained in relation to this
promotion or the acceptance of any prizes (whether or not arising from any person’s
negligence). The winners of the Promotion release the Promoter, the company
providing the prize and associated bodies from any and all causes of action, losses,
liability, damage, expense (including legal expenses) cost or charge suffered,
sustained or in any way incurred by each winner as a result of any loss or damage to
any physical property of each winner, or any injury to or death of any person arising
out of, or related to, or in any way connected with the Promoters or the prizes. All
Entrants release the company providing the prizes, associated bodies, against all
liability, cost, loss or expense arising out of acceptance of any prizes or participation in
the competition including (but not limited to) loss of income, personal injury and
damage to property and whether direct or consequential, foreseeable, due to some
negligent act or omission or otherwise.
11. The General Terms and Conditions form part of the Entry Conditions.
COMPETITION DATES
12. Competition commences on Monday, 30, April 2012 at 12.00am and closes Sunday,
27th May 2012 at 11.59:59pm. Entries must be received before the closing time and
date.
13. The competition prize draw for each winner will be drawn via NightClub on Monday,
28th May 2012 at 12:00am for all participating NightOwl Convenience Store or
NightOwl Super Store locations. The Promoter has up to and including 5 working days
in which to notify the winners.
14. No responsibility will be accepted by the Promoter for any ineligible or lost entries or
entries submitted or received by the Promoter after the closing date. Entries that do
not comply with the Entry Conditions or are incomplete, or submitted or received by
the Promoter after the closing date will be declared void.
HOW TO ENTER
15. To enter, Entrants must purchase any two (2) products from the Schweppes 1.25lt
range or Smith’s 175g range in one (1) transaction from any NightOwl Convenience
Store or NightOwl Super Store within Australia and collect a key tag from the
attendant. Once the keg tag has been received, an Entrant must (for the first entry)
log on to www.nightowl.com.au/NightClub during the promotional period and register
their details (including the barcode inscribed on the key tag) to become a member of
the NightOwl NightClub. Registering the Entrant’s details onto the website (including
the barcode inscribed on the key tag) will give the Entrant one entry into the Promotion
and that entry will grant the Entrant the chance to win one State of Origin jersey from
the store at which they purchased the Schweppes or Smith’s products.
16. Once an Entrant has registered as a NightOwl NightClub member, that Entrant may
increase its chances of winning by simply purchase any 2 products from the
Schweppes 1.25lt range or Smith’s 175g range in one transaction at any participating
NightOwl Convenience Store or NightOwl Super Store and having the key tag swiped
by the attendant.
17. Any Entrant may also increase its chances of winning by visiting the Promoter on
Facebook at www.facebook.com.au/nightowlconvenience and liking us. An Entrant
who likes the Promoter on Facebook will receive 10 additional entries into the
promotion as a onetime redeemable offer for the current promotion.
18. Any costs associated with accessing the Promotion website is the Entrant’s
responsibility and dependent on the internet service provider. Any contact details
entered incorrectly on the Promotion website shall be deemed invalid.
19. The first eligible entry drawn from each participating NightOwl Convenience Store
and/or NightOwl Super Store will win that prize offered by that participating store.
ENTRY REQUIREMENT AND CONFIRMATION
20. Entrants may only enter the Promotion in their own name.
PRIZE
21. The prize for each participating NightOwl Convenience Store or NightOwl Super Store
is as follows;
QLD Stores: One (1) 2012 State of Origin jersey - QLD. Size: Large (L)
NSW Stores: One (1) 2012 State of Origin jersey - NSW. Size: Large (L)
Jersey cannot be exchanged for a different size or state.
